Potential Index Settlement Forum
There may be some suggestion of another attempt to "provide the parties with a forum to discuss any issues concerning the appeal book" on this Wednesday 2005-03-12T1100. If so we should attend fully armed and in force.
See listing. The use of unnecessary force in the apprehension of Paul Barker or Daryl Wight has not been authorised.
We will then be 9 weeks and 4 days from Full Court listing on Monday 19 May at 10:15 a.m before French, Tamberlin and Mansfield JJ.
We have a full collection of documents, and half a draft index. It is not dark and we are not wearing sunglassses. Hit it.
By Tuesday we should deliver:
1. Updated Bound Collection covering recent events, with extra copy for Registrar Angela Josan.
2. Formal emails to Hetyey R with CC Josan R explaining reasons to include stuff that Paul Barker has gone to extraordinary lengths to exclude, together with the reasons he did so and the results of those measures.
3. Proposed timeline for delivery of Appeal Book itself on time if that date were to be vacated, and at least one such forum was to be held. (Say Wednesday 19 March with a view to actual final settlement by Hetyey R at formal appointment immediately after Easter, Wed 26 March).
4. Note that our outline of submissions is required by Monday 5 May. Their response by Monday 12 May.
5. That would still only give us to next Tuesday week, 18 March for finalizing Supplementary Notice of Appeal (including all the grounds which justify inclusion of all the documents we say should be included).
